Terms and Conditions
1. Identification of the Service Provider
In accordance with Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), the following information is provided:

CanaryPlay operates as an event organiser and commercial promoter.
2. Acceptance of Terms
By purchasing a ticket and/or attending any event promoted or organised by CanaryPlay, the customer expressly acknowledges that they have read, understood, and accepted these Terms and Conditions in full.
These Terms constitute a legally binding agreement between CanaryPlay and the purchaser.
3. Nature of Services
CanaryPlay:
- Organises and promotes entertainment events, including but not limited to boat parties and excursions.
- May act as commercial intermediary for events operated by third-party service providers.
Where events are operated by licensed third-party providers (e.g., maritime transport operators), operational responsibility, safety compliance, and maritime insurance coverage remain exclusively with the licensed operator.
4. Ticket Purchase and Payment
4.1 All tickets are subject to availability.
4.2 A contract is formed only once full payment has been successfully processed.
4.3 Payments are processed via authorised third-party providers such as Stripe and TicketTailor. CanaryPlay does not store complete payment card information.
4.4 The ticket grants a revocable licence to attend the specified event. It does not confer ownership rights.
4.5 Tickets are valid only for the date, time, and event stated.
5. Pricing and Taxes
5.1 All prices are displayed in Euros (€).
5.2 Prices may:
- Include applicable indirect taxes (including IGIC), or
- Be exempt in accordance with applicable Spanish tax regulations, including special tax regimes where applicable.
5.3 Booking or administrative fees may be charged separately and are non-refundable unless the event is cancelled by CanaryPlay.
6. Refund and Cancellation Policy
6.1 Customer Cancellation
Unless expressly stated otherwise:
- All ticket sales are final.
- Tickets are non-refundable.
- No refunds shall be issued for non-attendance, late arrival, or voluntary withdrawal.
6.2 Event Cancellation by CanaryPlay
If an event is cancelled by CanaryPlay, customers shall be entitled to:
- A full refund of the ticket price paid, or
- Transfer to an alternative date (where offered).
Refunds shall be processed using the original payment method.
6.3 Adverse Weather – Maritime Events
For boat events, the licensed vessel captain retains absolute authority regarding safety and navigation decisions.
If an event is cancelled due to unsafe sea or weather conditions:
- Customers shall be offered rescheduling or refund.
If the event proceeds as scheduled, no refund shall be granted.
7. Event Modifications
CanaryPlay reserves the right to modify:
- Event schedules
- Venues
- Vessel assignments
- Entertainment line-ups
- Operational details
Such modifications shall not constitute grounds for refund unless the change materially alters the nature of the event.
8. Age Restrictions
Unless otherwise stated, events are strictly limited to individuals aged 18 years or older.
Valid government-issued photo identification may be required.
Failure to present valid ID may result in denied entry without refund.
9. Code of Conduct and Right of Admission
CanaryPlay reserves the right to refuse entry or remove any participant without refund if they:
- Are intoxicated beyond safe limits
- Engage in disorderly, aggressive, or unsafe behaviour
- Fail to comply with safety instructions
- Endanger themselves or others
Decisions of staff and security personnel are final.
10. Assumption of Risk
By attending maritime or excursion-based events, participants acknowledge and accept:
- The inherent risks associated with maritime activities
- The potential risks related to alcohol consumption
- That participation is voluntary and at their own risk
Participants must comply with all instructions issued by event staff and vessel crew.
11. Limitation of Liability
To the maximum extent permitted by law:
- CanaryPlay shall not be liable for personal injury, loss, damage, or theft of personal property unless caused by proven negligence directly attributable to CanaryPlay.
- Where services are provided by third-party operators, liability for operational incidents rests with the licensed provider.
In all cases, CanaryPlay's financial liability shall be limited to the ticket price paid, except where mandatory consumer protection law provides otherwise.
12. Force Majeure
CanaryPlay shall not be held liable for failure to perform obligations due to events beyond reasonable control, including but not limited to:
- Extreme weather conditions
- Government restrictions
- Public health emergencies
- Strikes
- Civil disturbances
- Force majeure events
13. Image Rights
Events may be recorded, photographed, or filmed for promotional and commercial purposes.
By attending, participants grant CanaryPlay the right to use their image in promotional materials unless they explicitly notify staff in writing prior to the event.
14. Data Protection
Personal data is processed in accordance with:
- Regulation (EU) 2016/679 (GDPR)
- Spanish Organic Law on Data Protection

15. Governing Law and Jurisdiction
These Terms are governed by Spanish law.
Any disputes shall be submitted to the Courts and Tribunals of Las Palmas de Gran Canaria, unless mandatory consumer regulations provide otherwise.
